Are Postnuptial Agreements Legally Binding in the UK?

Similar to a prenuptial agreement, postnuptial agreements aren’t automatically legally binding in the UK. However, they have a good chance of being upheld in the event of a separation, as long as they are deemed fair by the courts, both parties took legal advice before signing, and there are no signs of coercion.

Can you get a postnup after marriage UK?

Yes, the definition of a postnuptial agreement is a financial agreement between a married couple about how their assets should be split if they separate. If this agreement happens before marriage, it’s usually called a prenuptial agreement.

Is a postnup as good as a prenup?

Postnuptial and Prenuptial agreements are seen as extremely similar in the eyes of the UK court and have a similar chance of being upheld. Some couples even have both as circumstances occur which change their agreement, such as having children.
